1. Cancellation Policy
1.1. The rights of cancellation and refund and any limitation expressed in these terms and conditions do not affect your statutory right as a consumer. Refunds in relation to products and services may only be credited to the credit or debit card originally used to make the purchase.
1.2. Classes are always subject to availability. At Yoga with a Gemini, I will always do my best to accommodate you in your chosen class. All reservation must be made via the website, using the provided links.
1.3. Any booked classes must be cancelled within 4 hours. If you're booked into a class, but miss it or cancel it with less than 4 hours notice, you will be charged for it.
1.4. In the unlikely event that there is a problem with the booking, please contact me as soon as possible and give me a reasonable opportunity to sort out any problems with you and reach a positive outcome.
1.5. Class fees are not refundable, in case you have to cancel your class, you'll be given a Class Voucher. The Class Voucher, if not used, expires 60 days from the date of purchase.
1.6. All Class packs expire within 6 months of purchase if not used.
1.7. I reserve the right to cancel any bookings where payment is not received before the event.
1.8. Out of consideration for the teacher and other students, and also for your own safety (the warm-up is an important aspect of each class), please be aware that if you are more than 5 minutes late for a class, you may not be able to train.

2. Physical exercise - risks and responsbilities
2.1. I take my responsibility as a yoga teacher seriously and it is important before you take part in my sessions that we have a clear understanding of where the boundaries of that responsibility lie.
2.2. During our session, I shall only provide instruction that I am qualified to give and I shall use all reasonable care and skill. Your wellbeing is at the heart of everything I do. However, any information or guidance I provide is not a substitute for the consultation, diagnosis or medical treatment of you doctor or healthcare provider. You must not rely on any information or guidance I provide to you as an alternative to medical advice from your doctor or healthcare provider and I expressly exclude all responsibility, and shall have no liability, for any damages, loss, or injury suffered by you or any third party as a result of your participation in my sessions or your reliance on any information or guidance I provide to you.
2.3. It is vital and your responsibility to provide me with correct information about yourself. I cannot be liable for any incorrect information provided by you.
2.4. If you have any specific questions or concerns about any medical matter, you should always consult your doctor or healthcare provider as soon as possible. If you think, you may be suffering from any medical condition, you should seek immediate medical attention from your healthcare provider.
2.5. You acknowledge that any form of exercise contains a degree of risk. Yoga may require some physical exertion, movement, twists, inversions and breathing techniques that can be a risk of injury. It is recommended that you check with your GP or healthcare provider before you start any new exercise program.
2.6. In particular, if you are (or might be) pregnant, you acknowledge that this has its own inherent risks and by taking part in my sessions you confirm that you have been given permission by your GP or other healthcare provider to practice yoga and you do not know any reason why you should not take part in my sessions.
2.7. If you have the following conditions you should consult a doctor before participating in yoga classes: low/high blood pressure, cardiac irregularities, diabetes, eating disorders, recent operations or ongoing injuries. If there is any doubt, please consult your doctor first.
2.8. Nothing in my session should cause you to experience any pain. If you experience any pain from any of the poses, you should stop immediately.
2.9. I shall provide you with a variety of alternative positions during my sessions and it is your responsibility to listen to your body and not push it beyond its limits. You should stop whenever you wish, especially if you experience any discomfort.
2.10. You understand that it is your responsibility to judge your physical and mental capabilities for physical exercise. You alone are responsible to decide whether to practice yoga or not.
2.11. Please, always remain mindful of your breath throughout the class and take appropriate rests by lying down if you notice any changes to your normal breathing pattern, or experience any breathlessness or dizziness.
2.12. In all classes whether face to face, live streamed remote or pre-recorded remote, always follow your teacher's safety instructions and listen to your body. Where a movement or class is beyond your experience or ability, feels too difficult for you, or you experience any pain or discomfort, please do not continue the movement or class.
2.13. It is your responsibility to inform me of any physical or psychological conditions or concerns that may affect your practice of yoga and inform me of any serious injury or illness at least 4 hours before every class, by phone or email and await for my reply before joining. Also, it is your responsibility to inform me of any medical changes.

2.14. By registering and participating in the class you agree that you read and understood the terms and conditions, and that you are physically fit and mentally capable of performing the physical activity you choose to participate in.
2.15. You accept that as with any breathing or physical activity the risk of death and injury, even serious or disabling, is always presented and cannot be entirely eliminated.
2.16. If you decide to practice yoga without consulting a physician or obtaining the necessary consent, you assume complete responsibility for your decision and any injury or other undesired consequences that may result from it.
2.17. You, your heirs and other legal respresentatives release Yoga with a Gemini (Eszter Nyiri) from all responsibility and liability arising out of any accident, injury, and illness now or in the future as a result of your use of the online classes, videos and other content. This includes, but is not limited to liability arising out of medical costs, legal fees and any consequent losses.

2.18. Any participants over the age of 16 and under the age of 18 must have a prior agreement of their parent or legal guardian, after a consultation with the yoga instructor, and these terms and agreements must have been read and signed by a parent or legal guardian and emailed to yogawithagemini@gmail.com prior to the class.
3. General Data Protection Regulation
3.1. I shall use the personal information you give to me to
3.1.1. provide the classes,
3.1.2. process your payment for the bookings or class packages,
3.1.3. inform you about any similar products and services that I provide, though you may stop receiving this information at any time by contacting me.
3.2. All information shared by you will be kept strictly confidential, except when releasing such information is required by law and/or where I consider it necessary to do so because of concerns of risk to yourself or others.
3.3. I shall not give your personal information to any third party unless you agree to it.
4. Additional terms and conditions for online classes and content
4.1. During online and pre-recorded classes, you will be practicing at home without me being able to monitor or guide you directly. If you use these contents, you implicitly agree to the following additional terms and conditions.
4.2. When practicing at home, please clear enough space around your mat so that you don't hurt yourself on any furniture if you lose your balance.
4.3. When you are taking part in live-streamed classes, please note that the instructor may not be able to see you at all times.
4.4. Please note, when you are taking part in a pre-recorded class, you will not be able to request specific adjustments or modifications.
4.5. It is your responsibility to ensure that by following the videos, you will not exceed your limits while performing such activity, and you will select the appropriate level of activity for your skills and abilities, as well as for any mental and physical conditions and/or limitations you have.
4.6. The ease, experience and difficulties while performing yoga vary from individual to induvidual. You should discover your own pace and make the required adjustments while practicing yoga. In case you experience any difficulties, you should pause, make necessary adjustments or skip the lesson altogether as needed. Please listen to your body and take periodic rests as needed.
4.7. You need to be aware that some yoga positions or other components of the online classes can be hazardous and have the potential to cause injury.
